SECOND: The bank after 90 days of not receiving a payment and not hearing from the owner about making a plan to pay, will refer the case to the Bank's lawyers. The Bank's lawyers will open a legal case in Supreme Court and file a "Summons & Complaint".

You will receive a copy of the "Summons & Complaint". IT IS VERY IMPORTANT THAT YOU "ANSWER" THE SUMMONS & COMPLAINT WITHIN 30 DAYS OR IT WILL NOT BE ACCEPTED. This answer must be done by a lawyer and we work with lawyers who are reasonable in their fees. If you do not answer the Summons& Complaint the Banks lawyers will file with the Court a "Judgment of Foreclosure and Sale". If you file an answer with the Court, the Banks Lawyer will have to take the time to respond to your answer. You can buy time by going back and forth with the answer and other legal motions.

THIRD: If you do not answer the Summons the court will issue a judgment. When the Judge signs the Judgment, The Banks lawyer can then put your house up for Auction.

FOURTH: As a last resort you can still file a bankruptcy but the law is very complicated and you should us an attorney to protect your interest.
